We are importing ELINCS-listed polymers and ECHA regards the monomers as already registered under REACH. Example: Polymer 1 contains 50 % monomer 1 + 25 % monomer 2 + 25 % monomer 3: notified 10-100 t/y Polymer 2 contains 75 % monomer 1 + 25 % monomer 2 + 0 % monomer 3: notified 10-100 t/y Monomers regarded as registered: Monomer 1: 50 t/y FROM polymer 1 + 75 t/y from polymer 2 = 125 t/y Monomer 2: 25 t/y from polymer 1 + 25 t/y from polymer 2 = 50 t/y Monomer 3: 25 t/y from polymer 1 = 25 t/y Question 1: Is this way of calculating from polymer to monomers correct? According to article 6 paragraph 3 each producer or importer of a polymer has to submit a registration to the European Chemical Agency (EChA) for the monomer substances or substances the polymer is consisting of. This registration has to be done, if the monomer substances are not yet registered by another actor up the supply chain, e.g. the producer of the monomer substances, the bound monomers content of the polymer is not less than 2 % w/w and the yearly amount is as many as one tonne per producer or importer. More detailed the proceedings related to polymers and monomers are described in the Guidance for monomers and polymers [english version (pdf-file, 410 kB)], which can be downloaded.

So it is absolutely correct to add up the identical monomer substances of different polymers if these polymers are consisting of more than one monomer substance, and if the 2 % w/w threshold is exceeded. The resulting tonnages of monomer 1 = 125 t/y, monomer 2 = 50 t/y and monomer 3 = 25 t/y means according to article 12 that the tonnage bands due to be registered are 100 to 1,000 t/y for monomer 1, and 10 to 100 t/y for monomers 2 and 3.

In this question the three monomer substances are described to be ELINCS listed and thereby being already registered. But that does not mean these substances to be already registered for all potential registrants. The ELINCS listed substances are considered registered exclusively for the applicant of the former notification process according to the EC chemicals directive 67/548/EEC. Thus for all other producers and importers the status of the ELINCS listed substance is equal to a non-phase-in substance. Therefore the ELINCS substance is no sooner allowed to be produced or imported until the registration process is completed.

Gemäß Art. 6 Abs. 3 muss jeder Hersteller oder Importeur eines Polymeren der Europäischen Chemikalien Agentur (EChA) eine Registrierung des Monomerstoffes oder der Monomerstoffe übermitteln, aus denen das Polymer besteht. Diese Registrierung muss dann durchgeführt werden, wenn die Monomerstoffe noch nicht durch einen vorgeschalteten Akteur der Lieferkette, wie z.B. den Hersteller der Monomerstoffe, registriert wurden, der Gehalt der gebundenen Monomere mindestens 2 % (w/w) und die Jahresmenge mindestens eine Tonne pro Hersteller oder Importeur beträgt. Somit ist es vollkommen richtig, die identischen Monomerstoffe in verschiedenen Polymeren aufzuaddieren, wenn die Polymeren aus mehr als einem Monomerstoff bestehen und der Schwellenwert von 2 % w/w überschritten wird. Die sich ergebenden Tonnagen des Monomers 1 = 125 t/Jahr, Monomers 2 = 50 t/Jahr und Monomers 3 = 50 t/Jahr bedeuten gemäß Art. 12, dass die zu registrierenden Tonnagebänder für Monomer 1 100 bis 1.000 t/Jahr und für die Monomeren 2 und 3 10 bis 100 t/Jahr betragen.

In der Fragestellung werden die drei Monomerstoffe als bereits in der ELINCS Liste enthalten und daher als bereits registriert beschrieben. Aber das bedeutet nicht, dass die drei Monomerstoffe für alle potentiellen Registranten als bereits registriert gelten. Die Stoffe der ELINCS Liste werden ausschließlich nur für die Anmelder des früheren Notifizierungsverfahrens gemäß der EG Stoffrichtlinie 67/548/EWG als registriert betrachtet. Daher ist für alle anderen Hersteller und Importeure der Status des ELINCS Listenstoffes der gleiche wie bei einem Nicht-Phase-in-Stoff. Daher darf der ELINCS Stoff nicht eher hergestellt oder importiert werden, bis das Registrierungsverfahren vollständig durchgeführt ist.
